A woman's same-sex partner has been granted parental rights over her adopted children. They live in Montana, which does not allow same-sex couples to adopt, so only one partner was listed on the adoption papers. The couple broke up in 2006, and the partner whose name was listed has since married.
"To discriminate further against Ms. Kulstad [non-adoptive partner] because of her sexual preference in this day and age is no different than telling a person to go to the back of the bus because of her skin color," [District Judge Ed] McLean wrote. It sounds like an interesting case. I'm sure it's going to be appealed. I wonder just how high it will go, and what the ultimate impact on same-sex relationships and family law will be.
