Oh fun

2007 was the worst year of my life by far and it's come back to haunt me. I got a summons this morning. I'm being sued by Capital One (who I have a current credit card with, ha) for $4,403.78. It's for an old credit card I had with them that was 90% my ex's debt, but in my name. Dumb thing to do. Lesson learned. That's a fun way to start the day. I just drafted up a cease and desist letter so they can only contact me by mail and wrote up the notice of appearance I have to file with the court. They sure as hell aren't getting a no-show default judgement out of me. If they want that old "alleged" debt they'll have to work for it. I'm hoping I can drag it out long enough to save 65-75% of what they want and settle for that out of court. I have to research and construct a formal answer and affirmative defenses over the weekend. Everything I'm finding is tailored to third party debt purchasers, though, and I'm being sued directly by the original debt holder... :( fun, fun, fun
