The NFL and the Supreme Court

So, I was listening to the news on my way home today and it turns out the NFL is going to the supreme court today. They have been sued by....American Needle, I think, for giving all the rights for NFL merchandise exclusively to Reebok ( Read more... )

American Needle is full of shit, quite frankly. The NFL is a corporate entity with trademarked product to sell. They are absolutely within their rights to decide who, if anyone, is allowed to produce merchandise with their trademarked images. The whole monopoly thing is a non-issue. That's the point of copyrighting/trademarking--you're the only one who gets to use it.

See, my thoughts on the monopoly issue is this: they're not stopping people from making and selling baseball caps, they are stopping people from selling thier images.

I hope the SC upholds the earlier rulings.

The NFL has all the rights. Congress gave them an exemption from anti-trust laws.

I doubt the SC will change that.

Even when the USFL won its lawsuit it only received $1 in damages, and it was destroyed by the NFL muscle in TV coverage, so yeah....

Yeah, I don't think American Needle has a case. I was just thinking about how we see them and the arguments the NBA guy made. 'Cause I do think that he's right.

NFL is the corporation. That's why American Needle can't put together a team and play against an NFL team.
