Там кстати очень "забавно" получилось с тушкой - во-1 учения были совместные с РФ, во-2 - в месте где тушку догнала ракета - была зона ответственности РФ, и небо там закрывать должны были вояки из РФ. Ну и в-3 - это было сильно за пределами заявленной дальности ракеты, вояки потом сами говорили что так попасть можно только случайно, если бы пытались сбить специально - скорее всего не попали бы. Что, конечно, не отменяет криворукости и мудачества ПВОшников тушку сбивших (2 с лишним минуты ракета летела после промаха по мишени, и все это время ни у кого не хватало яиц доложить "промазали" и отдать команду на ликвидацию ракеты.
Это надо в международном праве копаться, но, судя по всему, есть такая фича - признать ответственность без юридического признания вины. Видимо, это предполагает, что не будет копания в причинах и установления конкретных виновных, например. Со сбитым Ту-154 вроде как была версия, что учения были совместные и что у украинских военных не было техники, способной так сбить самолет.
