Proposition 8 sucks

Look, they want a fight. Now the US Supreme Court will get this shitstorm added to their docket. I rarely have confidence that the majority are interested in minority rights, and ballot initiatives allowed the majority to steamroll this hate into the constitution. Don't get me started on ballot initiatives, I believe they are unconstitutional and a symbol of legislative failure and ineptness. I now feel a civic duty to publicly harrass and impede anyone who asks for my signature on an initiative.

Now what we need is an Episcopal, Presbyterian, Unitarian, or Wiccan clergy to attempt to marry a couple of the same-sex, get denied, and then sue to have it struck down for conflicting with the Establishment Clause of the US Constitution. Clearly, if the various churches cannot agree among themselves what constitutes a valid marriage, then the state cannot step in and resolve a sectarian doctrinal dispute by law. That's clearly Establishment.

Then the other states that don't recognize same-sex marriage can be brought out of the dark ages by way of the Full Faith and Credit clause. Adam and Steve may not be able to tie the knot in Utah, but Utah will have to recognize their California marriage as valid.

Prop 8's backers know all this, but they want to piss on the California Constitution like a dog marking territory.
