From the decision issued by the Supreme Court of the United States in National Federation of Independent Business et al. v. Sebelius, Secretary of Health and Human Services, et al., certiorari to the United States Court of Appeals for the Eleventh Circuit, No 11-393, argued March 26, 27, 28, 2012 and decided June 28, 2012:

"Our precedent demonstrates that Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it."
