Thanks to wingedkami, my entire allotment of surfing time today (which should have been used to read my flist and do some archiving at tolkien_weekly) has been eaten by a surprisingly flame free literary flame war, in which a plagiarist completely failed to get the point about plagiarism and copyright infringement being crimes, and that people calling you on it isn't libel.

You cannot sue someone for pointing out, quite correctly, that you've broken the law. It just doesn't work.
