there is a book called Blowback. the authors name escapes me. covers this subject in detail and puts it in the context of making america a target for terrorism. absolutely fascinating read. high recommend it.
It took me not two minutes to find this. I excerpt:

Where do you get your facts? (I'm pretty comfortable with BBC's version of them, for now.)
None of which boils down to "Rape is not a war crime", especially when stated as such in the context of a list of other facts. I'm sure you have good points to make, but being loose with 'facts' is not a good way to get them heard, or taken to heart.
i still maintain that rape is NOT treated as a war crime since incidence of rape in war is almost always never addressed and almost always never pursued legally and this is a huge and weighted weapon used in war that no one dares or cares to question. it's an insanely large problem.
