You mention the penumbras, but IIRC, griswold is interesting because it was kind of the trial run for penumbras, before roe.

Also, damnit, I had been planning to write griswold.

It was! Parts of my brain keep telling me no, no, the penumbra theory has got to be older than that! But my brain is wrong.

Griswold came up on salon today too. Someone asked Palin if there were an inherent right to privacy in the constitution, and she said yes.

Which is a little bit of a gotcha, but mostly it gave them a reason to reprint McCain's speech from the 80s about how awful Griswold was.

Activist judges and all.
