so i guess every one has heard by now, we lost. proposition 2 passed, it is a texas contitutional amendment outlawing gay marriage. how can people be so biggoted? it came to mind that the supreme court would get involved and make everything better, but then i realized that bush has already usurped it and put all his cronies in. now what? i am ( Read more... )

In response to getting the federal government involved:

"Amendment 10-
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."

So basically, whatever is not elucidated or forbidden in the national Constitution is up to the states.

Or at least that's my understanding of it.

Oh- I forgot to mention that that is the 10th Amendment to the U.S. Constitution

but i believe the full faith and credit clause is supposed to allow a marriage in one state to transfer to the rest of the states.
