You CAN claim these charges backclaimbankchargeMay 4 2007, 12:37:13 UTC
The charges haven't officially been termed as "illegal", because the bank have stopped any cases from going to court, meaning there has never been a ruling.
The law says though that the penalty charges must represent the cost to the bank, and they banks are not allowed to profit from the charges. As the cost to the bank is estimated at £2.50 - £4.50, the banks ARE making a profit from them, putting the legality into doubt.
As a result you can claim back your charges for the last 6 years, or 5 years if you are in scotland. You will probably have to take the case to court, but the bank will refund you before the hearing. Even if there was a hearing (which won't happen as the banks won't tell the court their costs, as it would open up a flood of claims), you would win.
I run a site which can help you claim your bank charges back at www.claimbankchargesback.co.uk. The site is completely free to use, and offers detailed guides to the whole process of claiming your bank charges back. We explain why the charges are unfair, how to get copies of your statements for the last 6 years, and have template letters and spreadsheets you can put your own details into and send to the bank. We also have a newsletter to keep you up to date with the latest news, and forums for one to one advice.
Have a look through the site, and it will give you all the details you need to successfully claim your bank charges back from the bank (even if they tell you you can't!).
