so, the fucker is starting to get pretty fucking cocky for my taste.

g-dubs just signed into law, part of the 'tort reform' bill, the class action part. fucking asshole. im really in awe that the dude has adamantium balls that big.

now, i think that we all can agree that there are some cases where, yeah, the cases are pretty fucking trivial (and yes, i do know about the big class action cases where the lawyers come away with millions and the plaintiffs get nothing. my favorite was the one where the victims only got 33 cents, but the only way the could get the money was to send in a letter. a letter with a 34 cent stamp). but the funny thing is that the bill doesnt do anything to filter out the frivolous ones; it just makes it harder to bring class action lawsuits to court. if you say that the frivolous malpractice suits, et al, are a drag on the economy and we need to get rid of them, blah blah blah, why not create a filtering process for civil cases, similar to the grand jury process in criminal cases? part of the bill allows juries to penalize people for bringing frivolous cases, but that just seems a bit after the fact. i dont understand the logic of, "if we make it hard, then people wont try if the dont need to" because it also makes it harder for people bringing honest cases. all that this amounts to is limiting access to one of the most important institutions in our democracy.

by the way, do you ever wonder what these companies and doctors are doing to get sued so much? i mean, my understanding of things is that if you dont fuck up, or break the law, then you dont have to worry.

one piece of this that i dont understand, is why try and limit access to the courts? our society has evolved enough to where, if you are hurt, you take them to court, instead of fucking his shit up (most of the time. work with me on this). is that not what civil cases were created for? so that instead of reacting with violence or other means, you take your dispute to court, and settle things in a civil matter. so now, in the future, if a company poisons you (asbestos), what are you to do? i guess that g-dubs wants you to sit there and take it like a child molestor in a prison shower.

you know something, with the logic that bush is using, he should take a long look at himself. he has taken a personal injury case (9/11) and got $87,000,000,000. and counting. but the people that we actually harmed dont see any of it (i know about the 9/11 victims and family compensation funds, just follow me) while he reaps all the benifits. sounds a lot like the trial lawyers that he proports to hate.



g-dubs, as he is signing the bill. no, seriously.

oh, one of the other things that homeboy is working on, as a part of the whole tort reform thing, is ending the payouts for asbestos poisoning. who is the biggest defendant in the asbestos case, you ask? haliburton.
