So, I have been silent because I am desperately trying to get ready for the start of class next week, when I begin teaching Trademark and do another round of Copyright. For Trademark, I'm going to try to make a sort of medley of songs/quotes using trademarks as cultural shorthand (a Mickey Mouse operation, etc.). I have a bunch of songs, but I ( Read more... )

Ooh, nice. I was thinking of "If I had $1,000,000" with the Kraft Dinner line, but I might use "One Week" instead.

Damn straight. The sad thing is, they actually used it in a M-B commercial a few years back. I'd love to get footage of that commercial.

Either the Author's Guild or the Writer's Guild has been gathering examples of book titles that have trademarked terms used in them after the filing of Fox v. Franken -- it should be easy to find online either through Google or the usual suspects like Lessig.

Yeah, I've seen the list, though I have my own issues with the Author's Guild that make me less willing to wade through the large numbers of redundant and irrelevant posts. I do have wonderful pictures of the book covers -- Franken and O'Reilly both -- which I'm going to use. Though in general I'm going to try to coordinate image and sound, so "Marlboro man" with a picture of the guy, etc.

Not sure if this counts, but there are a couple of fun brand name references in Cake's Short Skirt/Long Jacket:

I want a girl with smooth liquidation
I want a girl with the right dividends
At Citibank we will meet accidentally
We’ll start to talk when she borrows my pen

She wants a car with a cupholder armrest
She wants a car that will get her there
She’s changing her name
From Kitty to Karen
She’s trading her MG for a white Chrysler LeBaron
I want a girl with a short skirt and a long jacket

There's also a fun copyright refence in the Dandy Warhol's new album, on the song "Welcome to the Monkeyhouse"

Wire is coming back
Elastica got sued by them
When Michael Jackson dies
We're covering "Blackbird"
And won't it be absurd then
When no one knows what song they just heard
Unless someone on the radio tells them first

Billy Joel, "Big Shot"

You went uptown riding in your limousine ( ... )

Thanks! For Billy Joel, I was thinking of using Pressure: "All your life is Channel 13/Sesame Street/What does it mean?"
