On July 12, four tax police officers from the Solomyansky district of Kiev came to raid the offices of the television channel TVi.
They presented a ruling of 07/09/2012 of Judge Ponomarenko of the Shevchenkivsky District Court of Kyiv as basis for the raid.
The ruling allows the seizure of primary financial, business and accounting records related to a certain tax credit of Teleradiosvit company, the broadcasting license owner of TVi.
The tax authorities are demanding records covering the period from 2008-2012. Therefore, all of the documents related to the company’s financial activities covering those years will be taken away. There is a danger it will paralyze the work of our TV channel.
According to the tax police officers, the documents are confiscated as a part of investigation of the criminal case № 79-0261 which was started against head of the TV channel Mykola Kniazhytsky (Part 3 of Article 212 of the Criminal Code -large scale tax evasion).
The case was initiated after a tax audit of TVi’s broadcasting company TRK Teleradiosvit. However, on June 25, 2012 the District Administrative Court of Kyiv overturned and annulled the decisions that claimed that Teleradiosvit was liable for taxes, and which became the basis for starting the criminal case.
Because the court’s ruling has not come into force yet, the tax police are ignoring it and proceeding with their investigation in an attempt to pressure the channel in general, and Kniazhytsky personally.
However, their actions violate paragraph 56.22 of Article 56 of the Tax Code, which states that if a taxpayer challenges the decision of tax authorities in court, prosecution of the company cannot be based on the tax authorities’ decision until the dispute is fully resolved in court.
