Once again, Scalia disappoints
Some of you may remember that the venerable Justice Scalia came to speak at Lewis & Clark (followed shortly after by Michael Moore) a few years ago. During his speech in which he defended his strict constructionist views, he said that if people wanted rights, the people should write and pass bills to ensure them. This prompted one audience member to comment that Oregon's physician-assisted suicide law fits that standard precisely. Scalia agreed that the PAS measure was the proper protocol for ensuring rights.
He agreed, that is, up until he actually had to vote on the issue.
Way for consistency.
And while I'm at it, what a disappointing start for Roberts. With Alito in there, too, we'll have a lovely cabal of literalists.
