the abu ghraib people were tried for their actions. whether you think that they should have tried rumsfeld or someone higher up than a lieutenant-general (or whatever the guy's rank was that they just put on trial) is personal opinion.
article 4 of the third geneva convention states that to be considered a prisoner of war the detainee must follow certain criteria inluding wearing a uniform, being part of a chain of command, and carrying arms openly. that doesnt really describe the people being held at guantanamo.
that part about rumsfeld selling gas to iraq is total crap. look at his 1983 talks with iraqi officials about containing iran (PDF), scroll down to page 9, and take a look at the third paragraph: "I made clear that our efforts to assist were inhibited by certain things that made it difficult for us citing the use of chemical weapons, possible escalation in the gulf, and human rights."

oh, i forgot the most important part about article 4: they have to follow the laws of war in their conduct, which very clearly state that you are not to specifically target civillians. which is kind of the entire point of being a tettorist.
