Advocating for myself Help Please if you can.
I am paying an attorney to further investigate why a story was fabricated and Temporary Restraining order filed about theft. the details when brought forward were simply not true, and there were credible witnesses that came forward immediately. Now, if you know me, you know my life style is clean and my degree is in Criminal Justice. I was mortified and it crushed me that someone would accuse me of taking a dime from my family.
Now, I find the truth is, when the social worker asked if they thought I might have done it, the answer was, well "your story is pretty convincing, but do you have any proof?" her response, "Well no, but do you have any proof she didn't do it?" So to protect his inheritance my family member chose to allow a petition for protection. Unfortunately the story the social worker gave the family member was alot less involved than the accusation. The accusation involved conflicting information that even the family member couldn't support.
Problem, this became a public record and without getting it expunged, without suing the social worker for defamation, I have to live with this black mark.
Now mind you. I obtained an attorney and the order was immediately vacated. The opposing Attorney had never actually called any witness and when she heard from one, she immediately begged the Judge to vacate the order. But advised my attorney there was more to the story and more to come.
I now have to fight to get this vacated order expunged from my record. It could hurt my chances of getting a job, even though I am quite innocent.
