Okay, I read a tech article that interested me, so I thought you might like to read it too:
The Stupidity of Consumers While I'll agree that some lawsuits are necessary in order to protect the consumer, ie., iPod batteries dying after warranty, and just products not being up to par, there are definitely trials that are plain stupid. Apple got sued because their iPods apparently play music too loud, and made someone deaf. Here's what the article says :
"In February, a genius (John Kiel Patterson) filed a lawsuit against Apple for failing to take adequate steps to prevent hearing loss. He claims that the iPod is capable of producing 115 decibels of audio levels, which is dangerous to our sensitive ears. No kidding, genius!"
Yeah, seriously! "No kidding, genius!" If something says high voltage, are you going to touch it and say "Ow! This company better lower the voltage on this thing!" I'd say every idiot knows that loud music hurts your ears, you don't need scientific evidence to prove that. Don't be dumb and turn up the volume to see if you'll lose your hearing; people who do that win Darwin awards.

While the ruling made Apple come out with a patch for iPods, I think Apple would have done it even if it hadn't been sued. First of all:
1) Don't do it. That was your own fault
2) Ask Apple (and other companies with pretty high scruples) nicely, and they'll probably do it.
