Upon further review, the following is my response to your issue with the “missing” money order and subsequent $12.00 bank charge.
I take exception with your statement that you have been neglected by our firm, and that we lost your money order, but I am forwarding this email to the maintenance and accounting departments for further review. This company has, in fact, held up its statutory obligation to both of you as evidenced by the repairs recently completed. The simple fact that we had four hurricanes hit us in succession recently, and still cured all of your maintenance concerns within 15 days of initial contact does not constitute neglect. According to Florida Statutes Chapter 83.49 (Landlord/Tenant), plumbing problems are considered the responsibility of the tenant, not the landlord. The owner has in good faith bourn the cost burden of the repairs, when she could have held you liable for same. Furthermore, the fact that you have chosen to pay with money orders rather that checks isn't our fault either. There is no way to “track” a money order. Moreover, I have specifically told you that we have no reason to believe that we ever received the "missing" money order in the first place. It was never cashed, which tells me we never received it, period. If we had made an error and posted the money order to the wrong account, it still would have been cashed upon the bank against which it was drawn in the first place. I will, however, speak with the owner of your property and see if she desires to rebate your rent $12.00. I'll follow up with you once I have an answer. Lastly, I do not handle maintenance issues; we have a maintenance department for that, therefore you need to direct your complaints to the attention of Pete Kavoklis, our maintenance foreman. I have already forwarded this email to Pete.

I mean... how can he say that PREEXISTING plumbing problems would be MY responsibility and that they were KIND enough to cover the costs! BULLSHIT!!!!!!!! Anyhow, I'm organizing all my materials this weekend and taking it to student legal services. I hate how every place here feels like they can hardcore fuck students!!!!! Grrrrrr.
