As for the "innocent" man, if he's living in a house that sells/does drugs on such a basis to get noticed by a police raid, he's just as guilty as they are for not having reported it prior. It's called aiding and abetting. No, it won't deserve the trumped up charge that the police will likely give him for possession, but it doesn't mean he's anywhere near innocent. It is indeed a regrettable situation, but hopefully one that isn't very common.
I am for the death penalty in very rare cases, where the intent and the deed are very clear. Murderers with no remorse, rapists who are repeat offenders, ect. The poor schmo who shot someone in his botched 7-11 raid? No. He will likely regret that for the rest of his life and has a chance at rehabilitation. A special plastic cell for Hannibal Lecter? Not a chance, that's all Hollywood. Save us all some money and grief, get it over with.
