He's smart enough to put forth people that the GOP look stupid and obstructionist (even more than they are) to turn down.

If they do turn him down, though, the Dems will come out in droves to the election and the next president, be it Bernie or Hillary can then nominate Barrack Obama as the next Justice. *dreaming the dream*
