I'm extremely pissed off that it passed but consider the unfortunate irony that the african american demographic which was highly energized and voted for Obama also happened to be the racial demographic with the highest Yes/No ratio (70% yes to 30% no) on Prop 8, even more so than the over-65s (59% yes 41% no) -- african americans are one group that really should know better when it comes to the taking away of civil rights ( ... )

So do I. I had it in mind that much of this is cultural, and I was honestly expecting the Latino vote to be higher on Yes.

I've been getting my data from here:

... and I noted the similarity when you display it with no filters vs. "less than 10% with a bachelor's degree".

Also it's worth mentioning that there was no stipulation in the proposition that would annul the marriages of those who already got legally married.

That would be a violation of the federal constitution's ex post facto clause.

That's not to say that there won't be people that will try to get the marriages annulled using prop 8 as a basis, but I don't think they have much of a case. This sort of thing could go to the SCOTUS -- and with Roberts, Alito, Scalia and Thomas on the court, Obama might get really lucky and replace all 5 of the other current justices (likely Stevens and Ginsberg, as they're old and in poor health, maybe Souter because he hates DC and wants to go back to NH, though I don't know about Kennedy or Breyer).

I wish I were as optimistic as you, Tim. I fear that some how the people who pushed Prop 8 through will find a way to annul same-sex marriages. In the end, this is a fight that sane folks will win, but it's going to be a long and bloody battle.

Here's hoping you're right.
