Also some incoming freshman are still minors when they leave home and get to college. Not many but there are some. And some are still minors when they get accepted and sign an acceptance letter. Legally the parents are still responsible for the student at that time. I think Clark made a smart move by making that policy only available to upperclassmen. Again not that I agree 100% ideally, but given the liability issue it was the right thing to do.
I guess if an incoming freshman is trans/intersex he/she can always write a letter or otherwise contact housing about his/her situation...the policy doesn't state anywhere that exceptions won't be made...as those things have to be taken on a case by case basis.
