Wow, I didn't know that this loophole existed- can't say I'm surprised, though. The homecare aide who took care of my grandfather for the last six months of his life is one of the most amazing people I've met; the service they provide is invaluable. They deserve all the help they can get.

I hate how the stories I've heard on this are all about how now it will be harder for senior citizens to afford help. Because yes, it's awful if anyone can't afford the care they need. But that doesn't mean the people doing these jobs are obligated to not want a living wage or basic protections.

You know what's extra stupid about that? Disability rights groups have been pushing for this for a long time. For some reason well paid workers lead to less abuse of PWDs and less caregiver burn out. Weird, right?
