Yeah, what about that. One would think that bringing this up would make you notice that this is actually one of the unresolvable flaws in enforcing the distinction, but I guess when just imagining the existence of a trans person serves as a slippery-slope appeal to absurdity, you don't have to think that far.

"The case is sure to be appealed to the 5th Circuit Court of Appeals. So far two different appeals court have struck down state bans on gay marriage. Since Windsor, there has been no split in the federal courts of appeal on this issue."
