The idea is not whether it's a direct copy; something doesn't have to be a direct copy to infringe on your trademark. If you take someone else's idea and improve upon it, then sell it, you owe that person your idea and thus properly should owe them royalties at least. Perhaps the makers of Candy Crush would've never gotten the idea for the base elements of their game (which is a match-three game based upon candy at its core) if they hadn't seen Candy Swipe. And it's clear that they see this legal challenge as a threat, otherwise they would've never bought that earlier trademark and then tried to sue Ransom out of existence.
