Voters do teeechnically have the right to vote for something that denies rights to certain groups of people (see: the California prop system, where anyone w/ the money and wherewithal can petition to add a proposed constitutional amendment or statute to the ballot; if it passes, it's law, just like that). It's just that voters who disagree also generally have the right to take that shit to court if it passes and they have a cause of action for it, i.e. it violates some basic fundamental right protected by the Constitution. Which is precisely what happened in the Prop 8 case.
The source of this guy's legal-stupid, among many, many other things. is that the Constitution outlaws slavery, and you can't fuck with the Constitution without majorly broad support, especially if you're a state assemblyman wtf???? and also he's just a dumbass.
