I had a credit card debt from 25 years ago that ended up in collections. (I was young and foolish and irresponsible). I ended up paying it off in full about 20 years ago. I kept all the paperwork from it-thank god. About 15 years ago, I started getting calls and collection letters for this debt. Different companies for the most part. And every single time, I've had to ask for proof of the debt and then send in a copy of the paperwork showing the debt was paid off. The collection agency then sells the debt off to another agency and the cycle starts all over again. Portfolio has bought this debt at least five times and they get more aggressive each time. This last time, I reported them to the State AG.
I don't blame the people in the trenches, since they are just trying to earn a living. I blame the people at the top who set the tone for the company and the people on the phone. They pressure them to make calls that skirt the law or outright break them. Many people don't know their rights under the FDCPA. They get intimidated into paying debts they don't owe for example or get verbally harassed like the person in this post.
Yes, there are some people that skip out on their debts. But there are many more, like Mr. Collier, who end up with debt they can't pay due to circumstances outside their control. And instead of having some compassion, these bottom feeder collection agencies treat them like dirt. They need to be punished to the fullest extent of the law, as permitted by the FDCPA.
