Franky is a Capo. He deserves to be a capo because he's excellent at standing around and telling people how to do things.

He can never be anything more than a capo, as he is not a blood relation to the Vescovo clan. He's been a vassal of the family his whole life.

HIIIIIIIIIIII~ Sam was previously a Contabile and if that position is being cut, I don't really see him being moved down, so he'd probably go up to Consigliere since he was born into the family and his brother is a Capo/dad was supposedly someone higher, maybe a Sotto Capo.

ALSO BECAUSE SAM WOULD BE A GOOD CONSIGLIERE. He's good at making rational decisions.
