My Social Problems professor is one of those touchy feeley psychiatrists. He is constantly telling us that we are too quiet and need to participate more. Today we were talking about crime as a social problem. Being that most of the people in my class are criminal justice majors, he was expecting a good amout of conversation.
He started by telling us what the three criteria for rape are 1) Intent 2)Threatening harm on the victim if no compliance and 3) Penetration. He then went on to talk about how he thought that penetration shouldn't be a main criteria. When I raise my hand and make the comment that you can't punish someone for just attempting to do something the same as someone who actually committed the crime. That would be like sentencing someone to death for attempted murder even though no life was lost and that would violate the 8th Amendment. His response to me was that I needed to think outside the box.
So just because I think that penetration needs to be a criteria for rape makes me think inside the box.
