Stupid is a chosen (or imposed) state of mind. Retarded is a physical condition that the person had no control over, they were born with it.

forgive my ignorance

is it legal to have a gun like this, with such magazine attached, with safety OFF in public place in California for a person without a permit?

i know that it is not safe
i am just curious how legal it is

She's assuming that she's above the law and what she's doing is just fine because she's wielding the gun to make a point. Which makes her in point of fact a terrorist, but she'll get away with it because nobody's going to impeach her over this (as a Senator, this would be necessary to prosecute).

The stupidity factor is that the laws of physics and in particular chemistry and mechanics don't give a damn about her political office: if her aides accidentally put a loaded drum onto that weapon, all it would take would be a twitch for her to spray fire into the audience. There's a reason why one should always assume a firearm is loaded and ready to fire, and hence never point one save at someone which it wouldn't be too much of a tragedy for oneself to actually shoot.
