Johnny Marr has been wanting to register The Smiths' name since 2018 so that third parties cannot profit off the band. Morrissey never responded, so Marr registered it himself.

In January 2024, as a "gesture of goodwill," Marr decided to assign joint ownership. Except Morrissey has yet to sign the document.

As for the future of the band?
-Moz alleged Marr ignored a "lucrative offer" to reunite... Marr says he actually said no
-Marr says there are no plans to tour as "The Smiths" with a different vocalist
-Marr turned down a greatest hits album, given that there are several in existence

The thought of a Smiths reunion/tour gained popularity among fans when Oasis announced their reunion. But given all of the above, that seems highly unlikely.
