No. Berry and Aubry separated in May 2010. Aubry filed to establish paternity and joint parental rights in December, Berry responded asking the courts to limited his interactions with the child as he was unsafe, and the custody battle began in February 2011. That is when she first claimed that Aubry made racist statements and had mental problems. She gave an interview discussing how she believed in the "one drop" rule, and her daughter was black, while her friends and anonymous sources made the claims about Aubry's racist behavior to the press. Years later, the court documents were unsealed and reported on her specific claims to the court about racism and incest. She petitioned the court to move to France in February 2012, and was denied in November.

They continued to tussle over child support into 2014, but appeared to settle down after that was finalized. Berry and Martinez divorced in 2015. She complained publicly about the unfair child support and her ex (Aubry) using it for himself in 2021, and succeeded in lowering her child support with the courts around this time. She had the payments capped again in 2023.

Right and she started dating Martinez in 2010 and divorced him in 2016. All that you've mentioned was while she was with Martinez.

The child support payments aside all the accusations she made about him were in the time where she and Martinez wanted to move to France.

Capping the child support etc I don't think was ever about how he was as a father but how he spent the money.

Yes, as I said in my initial comment, she was with Martinez pretty immediately after splitting with Aubry. But she did not, as you felt, co-parent peacefully with Aubry until she and Martinez were engaged and wanted to move. Their ugly fighting came pretty swiftly on the heels of their split, and her accusations of racism and mental illness came a year before she petitioned to leave the country. Her court documents also include accusations about Aubry being cruel during their relationship and their sex life being reduced to three times a year. Her complaints were not confined to struggles after their split. She specifically talked about his behavior as a partner and father while they were together, well before Martinez entered the picture.

Some may interpret Martinez as being the instigator behind the custody battle. But that implies that you believe she lied about Aubry being mentally ill and racist, which were pretty serious accusations. And she has continued to fight with Aubry over child support well after Martinez left the picture.

Again, I don't know what really happened. None of us do. But I think custody battles get very ugly, and no one here comes out looking too great.
