If he really is keeping her children from her illegally, then I hope this is helpful in her legal battle. But we don't have an actual source regarding the legality, just posts on Thread from Vivian Wilson. Not to say Vivian isn't telling the truth, but Vivian is the sole source. Neither Grimes nor her mother have made a similar claim (possibly because they cant, but also possibly because a formal decision hasn't been made).

A family friend went through a similar relationship breakdown (no marriage, young children born in the US, one parent from the US and one from Canada) and it was an absolute shit show until the custody agreement was nailed down. The kids could not leave the US until both parents agreed to an actual, legally binding custody agreement. Parents can't just unilaterally decide to take children across international borders, and even if Elon agreed to allow the children to travel to Canada, it doesn't necessarily mean his agreement was legally binding.

And even if Elon did renege on a legally binding agreement, I'm still not sure what Grimes expected. His track record is not exactly sterling. He is a bully who uses his money and power to get what he wants. Access to and control over his children would be no different.

We have heard no reason why she shouldn't have some form of custody and access to her children. Until we hear a valid reason for him to have sole custody of these kids, given his track record, I am going to continue to believe that this is abusive litigation, especially since he has a history of this kind of thing.

But yes, I agree. Even if she had some custody of her kids, that doesn't entitle her to take them out of the country.

I am sure that Grimes has gotten her way with things in the past using white woman tears so she probably believes that would work here. But white woman tears don't work when you are using them against white men.

Before a legal custody arrangement exists, it's two yeses/one no as to whether those kids can leave the US. If the kids are born in the US, they usually stay with the American parent in the US until there is a formal agreement to the contrary. If she can't stay in the US, she cannot be the custodial parent until an actual legal custody arrangement exists. You can file for emergency custody orders, but as she lives in and is a citizen of a foreign country, Elon likely wouldn't even have to pull out the fancy lawyers to mount a decent defence preventing their removal to a foreign country. This happens every single day when it comes to custody fights between ex-partners with different nationalities. It's unfortunate that this seems to be dragging on for as long as it is (and I would definitely believe that Elon is using abusive litigation strategies and throwing a lot of money around to ensure it does so), but it's also unsurprising that it's such a mess.
