If you refuse a breathalyzer, you should be automatically found guilty.
False positives exist. If you refuse a breathalyzer, you should be automatically found guilty.
This statement is the epitome of Copaganda.
Excercing your rights doesn't make you guilty.
Here are some foods that could cause a sober driver to register a false positive BAC test:
Sugary foods. Cinnamon rolls, honeybuns, protein bars, and pastry. Bread and pastries. Honey-glazed donuts, sandwiches, slices of pizza, croissants, Fruit and juice.
they’re pointing out that someone may, for good reason, refuse a breathalyzer due to the possibility for false positives, and so you should not be “automatically found guilty” for refusing one.
if you know for a fact that you are not intoxicated (bc you haven’t consumed alcohol) then you honestly SHOULD refuse a breathalyzer and submit to a blood test if required, bc a false positive on a breathalyzer will be a lot harder to get out from under than no breathalyzer and a negative blood test result.
it’s pretty wild to say anyone should be “automatically found guilty” of anything considering how shitty and corrupt a lot of american law enforcement is.
to shine a light on your ridiculousness, consider cops who also want to search a car just for funsies. if you refuse the search should you be considered automatically guilty?

I am not giving my DNA to any cop with a quota to fill.
Blood tests are much more accurate.

I was going to say that in a lot of places if you refuse a breathalyzer, they get a court order (I think) and make you have a blood test.
