“ The judge clearly thought extensively as to the defendant’s danger, citing that harm being brought to Willoughby’s husband and children as part of the plot was a significant aggravating factor”

Was harm being brought to the woman not enough?

Well I’ve already seen men complaining about it, saying he didn’t actually commit a crime.

That's not what's being implied by that quote. It's speaking about the part of the sentencing procedure that looks at aggravating factors to the offence (the things that bump the defendant up the range of punishment available to the judge to impose), which absolutely rightly includes the level of risk the defendant poses and the impact on secondary victims. It's not suggesting Holly as the primary victim was not by herself important enough for this guy to have earned a long sentence

I won't bore people going through the procedure (unless someone's interested, let me know) but what was done to Holly is absolutely the first thing looked at.

Welcome to ONTDU, take a seat! Lecture behind cut

[Spoiler (click to open)]After conviction the judge hears submissions from both sides on recommended sentence. Some of it's technical argument/references to precedent. The prosecution cites aggravating factors that increase sentence, provides victim statements. The defence cites any mitigating factors. If necessary the judge orders a pre-sentencing report on threat posed by the offender... )

Okay, that’s fair, and thank you for explaining. Out of context it does sound bad though, and it wouldn’t be the first time the danger to a woman from a man isn’t taken seriously on its own.

I totally get where you were coming from, it was a bad summary. Happens a lot when the press sums sentencing remarks and it frustrates me no end
