their argument seems to be “she didn’t suffer enough medically or financially for the abuse to be real/have mattered” and it might work with the general public. surviving is a strike against you and it’s wild.

Sometimes even that's not enough. Too many murder trial write ups read more like the murdered woman was the defendant than the abusive partner in the dock.

It doesn't change the fact that he is abusive, but I thought that it's more about: she had those issued prior, emotional distress and ptsd did not develop because of me.

oh, didn’t even think about that. but it can’t hold water, right? because he’s the only person she’s named as an abuser and is generally composed/thought of as very disciplined so this would be unusual. idk i’m not a lawyer but time will tell what they want it for.
