Hmmmm... I think that if someone is held financially liable, it has to be framed as a violation of consent. Because that's what it is. It isn't the herpes that's the problem (herpes is just a risk you run when having sex with people, given that something like 50% of the adult population has it) it's the fact that if someone point blank asks you about STDs and you lie, you have prevented them from giving informed consent to sex. THAT is the problem.

When it's framed as an issue of "they gave me a disease" that inhibits a culture of informed consent by increasing stigma. It actively makes ALL people less safe and benefits only a select few people who have the resources to sue a partner who might actually be able to pay out a settlement.

Like honestly it would be MORE useful if it had gone to trial and the end result was that Usher is forced to engage in a long running PSA campaign about safer sex practices. He settled out of court TWICE for the herpes thing - being held financially liable didn't even stop it from happening again! For me, the goal has GOT to be "moving toward a world where safer sex practices are more prevalent" rather than simply paying money to a random amount of people in the world who just happened to get herpes from a rich and famous man.
