Given this info and the other info we have learned about their pregnancies, children, and custody situation, I would not be surprised to learn that he has possession of the ova collected during their IVF process (or any embryos resulting from that), and that he has decided unilaterally about if and/or when to undertake surrogacies using them. Like I wouldn't be surprised at all to learn she had no awareness of the existence of one or both of the children until late in the pregnancy or even after they were already born.
I feel like that should not be legal????? Like both parties should need to consent to embryos formed using their eggs/sperm in order for the embryo to be implanted.
The laws vary so widely and in many places there's a lack of law entirely. I know Texas law for unmarried parents tends to give automatic physical and legal custody to the birth mother and the father only gets rights and responsibilities once paternity is established, but I'm not sure how that's impacted when the biological mother didn't birth the child.
