A new lawsuit was filed by a Jane Doe in Nassau County Supreme Court on Long Island, New York. This is the first suit to focus on sex crimes that allegedly took place earlier in Manson’s career. Brian Warner, as well as his former labels Interscope and Nothing Records, have been named as defendants. The charges against Warner are sexual battery and intentional infliction of emotional distress, citing Warner’s “emotional manipulation” which included “hostile and verbally abusive behavior.” The charges against the record labels include negligence and negligent supervision and retention, claiming that Warner’s record labels “were well-aware of Defendant Warner’s obsession with sexual violence and childhood sexual assault.”
Jane Doe’s attorney, Jeff Anderson, has filed multiple suits against the Roman Catholic Church over sexual abuse of children and raised widespread awareness of the scandal. He is also representing a woman who recently sued Aerosmith frontman Steven Tyler for sexual assault of a minor.
[sensitive content] Jane Doe said she was a 16 year old virgin when she met 26 year old Warner in September 1995 outside his tour bus after a Dallas concert (the age of consent in Texas is 17). She said that he invited her and one of the other younger girls onto his bus where he asked how old they were and what grade they were in. He also asked for their home addresses and phone numbers.
Per the lawsuit: "Defendant Warner performed various acts of criminal sexual conduct upon Plaintiff, who was a virgin at the time, including but not limited to forced copulation and vaginal penetration. One of the band members watched Defendant Warner sexually assault Plaintiff. Plaintiff was in pain, scared, upset, humiliated and confused. After he was done, Defendant Warner laughed at her. … Then Defendant Warner demanded Plaintiff to ‘get the fuck off of my bus’ and threatened Plaintiff that, if she told anyone, he would kill her and her family.”
Afterward, a crew member gave her an 800 phone number and password so she could call Warner. A few weeks later, he began calling her at home. She said Warner would ask for explicit pictures of her and her friends when he called her and chatted with her online. In December 1995 (while she was still 16), he had her travel to New Orleans to see him (the age of consent in Louisiana is 17). She alleges that he assaulted her again on the tour bus.
Per the lawsuit: “Defendant Warner then became more aggressive and again sexually assaulted Plaintiff, including kissing, biting her breast, oral copulation, and penetration. After the second assault, Defendant Warner acted in a kinder manner nicer to Plaintiff and told her that he wanted to see her again.”
In 1999, when she was 18, she spent four weeks on the road with him. She said during this time, he groomed, harassed, and sexually abused her.
Per the lawsuit: "While in Florida, Plaintiff considered going back home. Plaintiff spoke with Defendant Warner and revealed her vulnerabilities and a general lack of support she felt from her family. As he did on countless occasions, Defendant Warner exploited this vulnerability to keep Plaintiff under his control. Defendant Warner often made Plaintiff feel alone and isolated by telling her that no one understands her other than him, which included her family. At the time, Plaintiff believed Defendant Warner and was compelled to keep following him.”
“Throughout the tour and while within the State of New York, when Plaintiff was with Defendant Warner both on concert days and on off days, Defendant Warner coerced her to have sex with him. Defendant Warner often coerced Plaintiff to have sex with him and other band members or his assistant at the same time. Defendant Warner controlled what Plaintiff could do, who could touch Plaintiff, and who he wanted Plaintiff to be with sexually, all while providing Plaintiff with drugs.”
“At times, he began ridiculing Plaintiff, especially in the presence of other young female fans. Defendant Warner openly called her racial slurs and called her fat. At other times, Defendant Warner told Plaintiff she was beautiful and confided in her some of his most personal secrets. Plaintiff saw Defendant Warner almost every day (except when his fiancée was in town), before, during, and after his shows.”
According to the lawsuit, the same year that Warner met Jane Doe (1995), he did an interview with Purr magazine where he said, “I have always found that the best and most exciting stories on the road are better left a secret because the statute of limitations. I’ve grown accustomed to getting sexual excitement out of a girl's screaming. There’s something about a terrified girl that I find exciting.”
Warner’s attorney, Howard King, says Warner “does not know this individual and has no recollection of ever having met her 28 years ago. He certainly was never intimate with her.” He went on to call Doe’s allegations a “fabricated tale” and added that “even the most minimal amount of scrutiny reveals the obvious discrepancies in her ever-shifting stories as well as her extensive collusion with other false accusers … Brian will not submit to this shakedown - and the courts won’t fall for it either.”
