I, personally, would use every resource I had to fight to never allow this man to see my kids again.

effie posted texts that she's trying to get the courts involved as he's still out of control and she just wants the kids safe

That's good. Maybe why the divorce isn't finalised?

out of control in what way? I don’t doubt it but isn’t he tucked away doing shady business somewhere?

yeah it is completely fucked up and there is no reason for it. i can’t even fathom what is going through her head here to justify doing this. it is quite frankly disgusting behavior

That is next to impossible, and doesn't even have to do anything with his status. Termination of parental rights hardly ever happens. I personally know people of quite low social standing (meaning only that they wouldn't have had community support or afford expensive lawyers) who have done horrific things to their children, and they are separated from them, but they still retain parental rights and are allowed to see them.

this made me think of that horrible story from years ago where this guy killed his wife and was still allowed to see his children until he committed murder-suicide taking himself and the children out.

sometimes, kids shouldn't be with their parents, man. that shouldn't always be looked at as the default best case scenario.

I agree 100%. I don't quite understand why parental rights are held of such high value. Higher than the safety of children sometimes. I don't quite get, why there isn't an analogue of a "unforgivable curse" so to speak.
And another thing, that absolutely kills me, also from personal experience, is that children are taken away from Native Americans for the same reasons they are kept with white parents. Like, it should be in the history books, yet to me it's first hand knowledge. I digress, though, sorry.

I think a lot of it has to do with children still being widely considered to be "property", especially of their fathers. And while white fathers are valued and their property deserves protection, Native fathers are considered a barbaric threat and should have their "property" and legacy taken away to reduce the existence of their Native society and white-ify their children (although they will always be considered 2nd class members of society). And when it comes to abusive white mothers, usually when there's no dad in the picture, it's the archaic belief that a woman should have a child to take care of and a child should always grow up with a mum.
imo it all boils down to sexism, racism and a patriarchal world view. It's rarely really about the child and its welfare :/
