Shameful. Both the US and Canada have to reckon with their original sin and its pervasive and sustained oppression of Indigenous people. The fact that Indigenous communities have to litigate land and title is enough to make one sick. A body of white men and women deciding something they could never understand, driven by laws and a constitution never meant to protect....The world sucks.

Environmental law in the US is actual crap. There are no teeth and are frequently procedural and NOT protective. This case was voted on for a technicality- who was the legal right to offer land access. Honestly the Park Service and Fish and Wildlife overlap a lot and sometimes dont have a good function for determining who is the agency with jurisdiction (particularly if its a multi-agency project).

This is not going to allow the project to move forward, it has multiple lawsuits against it that need to be settled.

When I heard about this new ruling, as a foreigner I was so confused like I didn’t even know that was a thing before. Seemed crazy to me that this wasn’t a given ...
