Legal memeage, ganked from
silverstah and others:
As evidenced by Katie Couric, Sarah Palin is unable to name any Supreme Court Case other than Roe v. Wade. (note that this is meme statement, not mine, i have not watched the whole i'view and so hesitate to weigh in on such a broad statement).
The Rules: Post info about ONE Supreme Court decision, modern or historic to your lj. (Any decision, as long as it's not Roe v. Wade.) For those who see this on your f-list, take the meme to your OWN lj to spread the fun.
Go forth, and edumacate!
My all time favorite,
Burnham v Superior Court:
The facts are simple... The Burnhams were getting divorced. Mrs. Burnham sued for divorce in California. While Mr. Burnham was in California briefly he was served process. The question - was the processes served legally.
What I love about the case? We get a unanimous end result with four concurring decissions, including a spat between Brennan and Scalia.
Scalia says of course the process was valid, its always been considered valid (and sites a Brittish case from 1612). He then proceeds to mock Brennan for trying to apply contemporary notions to the issue.
Brennan applies the logic the Court has used in all other more complicated jurisdiction issues to establish that the logic works even in the most basic of scenarios. He then mocks Scalia for, essentially, falling into Oliver Wendell Holmes "It is revolting to have no better reason for a rule of law than that so it was laid down in the time of Henry IV."
White essentially says, you are both right, please stop fighting.
Stevens earns my undying respect asks why they are even hearing the case since everyone agrees up and down the line. In a nut shell he asks 'dont we have better things to be doing with our time?'
