ATTN: Stop & Shop store #804 store manager Tom Rebele, Local 1262 workers union, Stop & Shop personnel Department

Subject: Counseling

In compliance to the union contract, if sick I am required to call in and notify the store. I’ve done that with regard to the dates 5/8, 5/21, and 6/19. This has been three days and Paul Melendez acts as if this is excessive. His concerns should be as per contract I followed what was written in regard to calling the store in event of sickness. His concerns should be the payment of my sick time as per contract whereas I have not been paid, which is a violation of a labor law. He cites as excessive call outs two days in 2004, two days 2005, and one day in 2006. We are six months away from 2007 so why are we discussing 2004? He has them listed as no call no show. The fact is that I’m a part time worker and he needs to comply with my requested schedule whereas I have prior commitments. He was told in advance my schedule and availability. He’s creating a problem by not complying with my schedule. In regard to the days of 6/30-7/4, I had a foot operation and furnished a doctor’s note, called in and notified the store as per contract. If management cannot relay messages, they should have a system set in place. All I can do is call. He has “4th of July holiday weekend” spelled out on counseling paper. His attempt is to create a condition by using the “July 4th holiday weekend” in addition to the cited days in 2004 and 2005 to insinuate his personal feelings as at to the reason of my absence. I think in the future its essential for us to work together and when I give a schedule in advance he needs to respect it. As far as his personal preference, whether its to me as a young person or to me as a black person he needs to treat me with the same dignity as others whether he wants to accept doctor notes or the phone calls has to do with more of a personal preference that union contract or company policy.
