From
fukken_saved, from her front-row seat in Wichita:
Nine retired U.S. Air Force generals have filed a complaint with Kansas regulators seeking the disbarment of 10 lawyers who belong to a Topeka church that protests at military funerals around the country.
In their complaint filed earlier this month with the Kansas Board for Discipline of Attorneys, the generals contend that the 10 members of the Westboro Baptist Church violated the state's professional conduct rules for lawyers.
From
the Topeka Capitol-Journal article, "A summary of the grievance:"- Failure to maintain integrity of the profession by engaging in dishonest, deceit or misrepresentation, "regardless of whether it is directly connected to a legal proceeding."
- Violation of a rule forbidding lawyers from abusing legal procedure by not making good-faith arguments and engaging in activities to harass or maliciously injure a person.
- Neglect of a provision mandating lawyers observe standards of conduct, "professionally and personally," whether or not the acts or omissions occurred in the course of an attorney-client relationship.
- Failure to report instances of professional misconduct of peers in Westboro Baptist Church.
I hate to say it, and so does he, but
this Kansas.com commenter may be right. "[B]asically the generals are alleging that the attorneys make a nuisance of themselves ... which is something that could equally have been said of lawyers who were agitating for civil rights in the 1960s."
While one might argue that such a powerful group wouldn't bring a lawsuit unless their counsel thought it was viable, the Phelches have been able to harass mourners for 20 years without any legal repercussions - and it's extremely possible the generals intend to pull strings behind the scenes. Much as I'd like to see the WBC go down, I don't want to see the big brass
subverting the rule of law any further, especially if it will set a legal precedent.
