I suspect it won't be fanart or fic etc, as 'Fair Use laws' allow people to do that without risk of harassment.
I think the article said it might affect vidders because they do download shows/music for the creations they make, not necessarily fanficcers or fanartists? Anyway you slice it though it will affect fandom in a major way.
I wonder if this is passed into law, if not, they may be breeching privacy laws, even their own, I would if in the US seek legal opinon on this
The thing is, it's not a law. At least not necessarily. The way I understand it is, internet providers are private organizations (in that they don't have one central governing body) that may choose to implement this or not - it's up to the internet provider you use, so would getting into the legal side help at all? I'm not sure. Anyway, I could be wrong - politics and laws go over my head most of the time.
