The Fight For Termite Is way less Over Than I thought



So 2 months ago we got a letter that said in effect

Dear the Vintur. Family and not the squatters,

your yearly taxes are $182 plus previous bill of 30 years of unpaid taxes and fines is $105000.

you are in ADJUDICATION STATUS and the city owns your building.

you were adjudicated in 1978 and then again in 1992. so the city owns you twice and you are in trouble.

pay 2009 taxes if you really want to, cuz we own you regardless.

love, morteville tax and finance and treasury.

So my thought on this was to go to city hall who have demonstrated a readyness to let us own and renovate our property and are nice enuff to leave us mostly alone since we agreed to ban traveller guests and just be a quiet neighbour friendly construction site. I took this as a half way concession that we own this house. I dressed like i was going to court which for today ment a totally micro flower print sun dress. I wasn't expecting to sit in that many offices and i felt a lilttle tiny bit vulnerable in there a few times.

The city Attorney Made friends with new guy Christopher Lund. Lund happens to be making it a personal project to research tax law and knows the Homesteader claim laws well and waspleasently alarmed that we have been doing this without a real lawyer for years now. SECTION 11 OF RS 9:5633, THE HOMESTEADER CLAIM LAW, says that we own nuthing untill we negate the adjudication status. Tax amnesty, the law that says we should be able to settle our adjudication status for $14300, the assessed value of land and building, well its a real legal option but it has to be applied for before a special court at NORedevelopmentAuthority. NORA are not our allies or enemies. mostly my relationship with NORA was meeting with Big guy Norris Butler and having him be kindly dismissive of our attempts at legal work.

NORA the only thing we can really do to settle to ownership of termite is to actually apply at NORA for the tax exemption program. NORA application process for that is that we ask for the right to begin Adverse Possession of the property. we allready began that 4 years ago and are well in to renovations and repairs. Chris Lund Was shocked and bewildered by how we wound up in this state with this house. Further he was surprised that we actually have the support and encouragement of the Vintur. family. Technically then, our possession is NOT "ADVERSE". let no one confuse our CORPOREAL POSSESSION OF AN ABANDONED PROPERTY, with some version of the Family some how transfering us ownership and we are eligible to cancell most of the back taxes.

the FamilyI get no favours from the family asside from their not contesting our efforts to take a hundred thousand doillars in dept from them. ATTORNEY LUND says the house is in additional limbo as not only is the former owner no longer with us, but there was never any act of succession posted. The next of kin of the former owner are all now in their 70s and 80s and are not interested in claiming responsibility for a million dollars in back taxes on a few collapsing buildings. it is possible That the family would have to option of posting an affadavit of succession and then they could apply for the tax amnesty program and then sell us the house for $14300 plus whatever mark up they'd want for their serious inconvienience. I'm going to even delete that very suggestion before i next mail corespondence to the family. I try to keep them posted on what we are doing but our agreement is that they won't contest our attempts at ownership as long as they are not involved in this in any way at all.

department of treasury and finance after hours of sitting with an accountant having her adding machine up 3 pages of print outs she declared that we infact have to hand over $113000. No one in the city tax office even wanted to hear anything about the tax amnesty program. New Aquaintence, city treasurer, Walter O'Brian, Made some light hearted fun of us, called us "the sqatter law people" and said Attorney Lund don't know nuthin unless he starts sending him written out justifiable arguments for the law he cites.

so in partial rehash, Taxes called us sqatters and we have a really funny reputation at city hall. the City attorney's office likes us so far but I gotta stay friends with Lund and ask him for help with NORA. Cuz for NORA i have to file papers to ask for my house starting from the very beggining asking permision to have that house in the first place. We right now have our house and a bunch of safety and health code permits to show that we are on this. Zoning and permits like us cuz we jump through any hoop they stick in front of us real pretty.

And after last week there is definately no way I'm going to write my own deed for that house. We have adjudication status on top of us and the city has said that if they ever decide to they can take our house and hand it over to, in our district, the organisation CATHOLIC CHARITIES who remodel houses and flip them to low income peoples. Hopefully Catholic charities will take a shine to a progressive Anglican like myself. Toldja I'm'a Xtian !!! If you don't got religion how can you do communitee related activism !!!

So I may or may not have to go plead my case to catholic charities.

That depends on
a. if catholic charities move down the list of adjudicated propertieds all the way to us and come by the house and meet us and god only knows how they are gonna responde to our assertion of our right to ownership.

b. If NORA are willing to take our application to aquire the property and we don't get in some kinna hassle for having allready aquired the property 4 years ago and then we have a 270 day dedline to to acheive our certificate of occupancy that we really need to finish before we even get allowed to reside here.

AND i DO NOT HAVE $14300. i HAVE MAYBE $4300. AND THAT IS PAINFULL TO GET AHOLD OF. ten thousand dollars. that would be twenty benefit shows with a really big turn out at each one and nobuddy but termite getting money. My mom just sold her house cuz shes going broke but maybe she'd loan me 10 k.

i really need a job and also to just accept that i will some day be homeless again. I been there i can do that.

Do you see why I'm stressed out this month.

THINGS TO DO

1. File affadavit of possession with our corporate name and up dated description of our assertion of our right to the property.

2. file Notice Of Intent To Preserve Interest which is a californyeh document and i wonder if they will accept it at the Lou-easy-anna assessors office. Its basicly an affadavit claiming OWNERSHIP of the property were the affadavit of possession claims only POSSESSION. as in "I own this" vs. "i have this".

3. I'm going to modify the application to NORA to assert our ownership allready while I'm supposed to be asking permision for ownership.

I think we have time to get our renovations a little further along without inflating the value of our home to much cuz we are going to be appraised again to determine what were worth/ have to pay the city to cancell adjudication. I have to copy and paste all the nonscence that this entails.

I'm very affraid of NORA. I'm'a mail this to Attorney Lund instead and see if he can figure this out.

AND WHILE ALL THIS IS HAPPENEING i HAVE TO LEAVE THE COUNTRY FOR A FEW MONTHS TO TRY TO GET MY IDENTITY PAPERS AND SUCH IN ORDER.

I AM REALLY FUCKING FRUSTRATED AND FEEL TRAPPED AND LIKE I'M RUNNING ON A HAMSTER WHEEL AND THE TEMPTATION TO JUST GIVE UP AND GO BACK TO BEING AN ILLEGITIMATE HOMELESS SQATTER WOULD HAVE ALOT LESS RESPONSIBILITY FOR ONLY A SLIGHT REDUCTION IN THE CERTAINTY OF MY FUTURE.

You're supposed to not be affraid to try to extend your grasp and take chances though right ??? thats what they teach us in after school specials.

focus on getting a truck, butter, focus on getting ID papers and a truck and dont put all your eggs in the house, just a quarter of the eggs, and even in the worst case scenario of loosing everything, that aint gonna happen any time soon and if it did then I'd really fight. Or really have a reason to flip out like this.

blighted property developement proposal.
funding comitment letter.
executed NORA purchase agreement.

can i just make those up ???

blighted properties inspection report is what i have to order from them.

This fucking document says that as soon as i get permission i got 270 days to get rehabilitation (certificate of occupancy ?) after which my right to tax amnesty is waived.

this scares the hell outta me.

OK this isn't ready at all yet but i want to contract for the appraisal. I just dont want to ask for tax foregiveness cuz i have to agree to rehabilitate the house in 270 days and i dont wanna do that untill i know we can do that real easy.
