*sigh* so much for the Supreme Court being a final arbiter of "justice." With it tilted so conservative now, unless the theories that Roberts isn't as conservative as they hoped are true, a majority of roberts/scalito/scalia/thomas/kennedy will be able to do pretty much whatever they want. Honestly, the way it used to be was appropriate - 4 liberals, 4 cons, and a moderate who split either way. Not ideal, but at least it prevented anomalous opinions from either flank.
Let's hope we don't go back to the Lockner era. :(
The Lochner era, based on that article, is actually not a bad piece've shorthand for the "meocon" (™ bellatrys) program: when they had it best, what they want to bring back.
