i have been having problems with noodles & company, because they won't pay for my ER bill when i cut my thumb open 2 years ago! so i was going to sue them, but the lawyer never called me back. plus, i found out that once a case wasa opened there was a time limit for when the case has to be solved by, and i really don't have very much spare time to spend dealing with this. i also tried to file for a hearing through the work force development center, but it was going to cost me $100 to $200 to get a doctor to fill out the required paperwork, which i am not going to pay to get noodles to pay for something that they should have taken care of 2 years ago! i've been fighting them for about 8 months now, and i still haven't gotten any type of response. the manager that i've been calling has never called me! for 8 months! nothing! so i emailed contact 6, and i'm really hoping that they'll be able to help me...this is my letter:

Hi,

My name is Wendy Yuen, and I have a really big issue that I need help resolving.

Almost 2 years ago, when I was working at Noodles & Company (Racine, WI), I cut my thumb open when I was cleaning in the kitchen. That night, my GM (Craig) didn't even send me home or to the hospital. He made me work the rest of the night, and even when it came to closing time and I finished everything I needed to get done; he still was hesitant to let me leave. After I left, I had to drive myself home, and that's when my parents brought me to the ER.

I did everything that I had to do to file for worker's compensation. When I was at the hospital I was sure to tell them that it was a work related injury, and I went to work the next day to hand in my work slip and to talk to the assistant manager (Amy) about what happened. She took care of all the paperwork for filing the worker's compensation. She had me write a letter explaining what happened that night. I also gave her my receipts to get refunded for my medication.

After awhile I received a check for my medication, and I didn't hear anything afterwards. So I only assumed that everything was taken care of, but in August we were sent a bill for my ER visit from the hospital.

Since August I have been trying to get them to pay, but they have not been responding. I brought it to Amy's attention, who was the assistant manager, but is now the GM there. She said she contacted them, but the person was on vacation. Every time I called I had to leave a message, and no one would ever call me back.

In the beginning I was given the wrong number, and some lady named Andrea responded to my phone calls. The irony is that she had nothing to do with my claim or the insurance company (Zurich), but she offered to help me with my situation. So she also tried calling the insurance company, and they told her that they would contact the hospital. I continuously called the hospital and called the Zurich insurance company. The hospital kept telling me that they never heard anything from the insurance company, and nobody would respond to my phone calls from Zurich. So I continued to keep in touch with Andrea, who helped me call to check up on the insurance company. They told her that they already contacted the hospital and told them to send over the right paperwork, but again the hospital still said they didn't hear anything from them. The adjuster who was working on my claim is no longer working with them, so every time I call I'm transferred to the manager (Alice Weber)...who never seems to be in. I always leave a message, and I've never heard back from her.

It has now been 8 months since I started trying to get them to pay after I received the bill. There has been no action taken, so I decided to contact the Work Force Development Center. They told me I could file for a hearing by filling out the paperwork they would send me, so I went on to do that when I found out that it would cost me anywhere from $100 - $200 to get a doctor to fill out the paper. I don’t see why I should have to pay any money to get them to pay for my ER visit, when it was something that should have been taken care of almost 2 years ago. This is when I figured I’d try to get a lawyer to sue, but the lawyer I was told to contact never called me back either. I was recently told that once a lawsuit is open that there's a time limit on when the case has to be resolved. This is a huge problem for me though, because I have two jobs now. I normally don’t get off of my first job till about 5 PM or 5:30 PM, and I start my next job at 6 PM. So it's hard for me to find time to do anything besides work, eat, and sleep. This is also the reason why I've stopped playing phone tag with them and contacting Andrea. Now that I work until such a late time, I can’t even contact the hospital. So I decided to try contacting you guys, so please, if you can, help me! I really don't know what else to do.

i got a lot done today, i think. :) i worked, sent this email, started typing up a college essay, and bought a bra for the dress i bought for the wedding in june. i had to get a convertible bra. heh.
