A Las Cruces teen died Monday after a rollover accident last week that police say was caused by a drunken driver.

Erika Chavarria, 18, was pronounced dead at Thomason Hospital, according to a news release from the Doña Ana County Sheriff’s Department. She was a passenger in a vehicle leaving the Southern New Mexico State Fair Thursday night when the driver lost control.

The driver, 20-year-old Jeffrey Nieto of Las Cruces, remains jailed at the Doña Ana County Detention Center on a charge of driving while intoxicated. Sheriff’s Deputy Natalie Williams said investigators are awaiting tests and don’t yet know his blood-alcohol level.

She did not know if Chavarria and the other passenger in the vehicle, 21-year-old Jeffrey Williams, had been drinking.

The trio left the fair about 11 p.m. Thursday, headed east in a 2004 Nissan pickup truck on Robert Larsen Boulevard. The sheriff’s spokeswoman said Nieto was “driving too fast” and lost control.
The truck cleared the fence separating the road from Interstate 10, rolling several times and ejecting all three before coming to rest near the highway.

None of the three were wearing seat belts, the release states. Nieto suffered cuts and bruises. Williams broke an arm and suffered cuts and bruises.

Chavarria, who was sitting on Williams’ lap, suffered massive head trauma.

The accident remains under investigation and further charges are pending against Nieto, the release states.
